Terms of Service

1. Acceptance of Terms

By accessing or using We The Owl ("the Site"), operated by Brix Tech Solutions, you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.

2. Description of Service

We The Owl is an online job board dedicated to overnight, graveyard, and night shift employment opportunities in the United States. We provide a platform for employers to post job listings and for job seekers to discover and apply to those listings. We also provide a community discussion board where job seekers can post questions, share experiences, and connect with other night shift workers.

3. User Accounts

You may create an account as either a job seeker or an employer. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and truthful information when registering.

Employer accounts are restricted to verified business email addresses. We reserve the right to terminate accounts that violate these terms or that we determine are fraudulent.

Job seekers who use the community board choose a public username. That username, along with any city, industry, job title, or bio you add to your profile, is shown publicly and does not need to match your legal name.

4. Employer Responsibilities

Employers are solely responsible for the accuracy, legality, and completeness of job listings they post. By posting a job, you represent that:

  • The position is real and currently available
  • The listing does not violate any applicable laws, including equal employment opportunity laws
  • You have the authority to hire for the position
  • The listed compensation and shift hours are accurate

We reserve the right to remove any listing at our discretion.

5. Job Seeker Responsibilities

Job seekers are responsible for the accuracy of information submitted in applications, including resumes and cover letters. You agree not to submit false or misleading information to employers.

6. Community Content

The community board lets registered users post discussions, questions, and comments, and upvote content posted by others. Anything you post to the community board is public. It is visible to anyone who visits the Site, including visitors who are not logged in, and it may be indexed by search engines.

You are solely responsible for what you post. By posting content to the community board, you grant We The Owl a nonexclusive, royalty free license to display, reproduce, and distribute that content on the Site.

We may remove, hide, or edit community content at our discretion, and we may suspend or terminate an account for violating these Terms. Users can report content they believe violates these Terms. We review reports but are not obligated to act on any particular one.

Badges and reputation scores shown on the community board are cosmetic. They carry no monetary value and cannot be transferred, sold, or redeemed.

7. Payments and Subscriptions

Employer posting plans are offered on a per-listing, monthly, or annual basis. New employer accounts receive a 60-day free trial. Payments are processed securely through Stripe. Subscriptions renew automatically unless cancelled before the renewal date. All sales are final unless otherwise required by law.

8. Prohibited Conduct

You agree not to:

  • Post fraudulent, misleading, or illegal job listings
  • Scrape or harvest data from the Site without permission
  • Use the Site to spam or harass other users
  • Attempt to gain unauthorized access to any part of the Site
  • Post content that is discriminatory, hateful, or violates applicable law
  • Post content on the community board that is defamatory, threatens harm, or shares another person's private information without their consent
  • Impersonate another user or misrepresent your affiliation with any person or organization
  • Use the community board to advertise products or services unrelated to night shift work

9. Intellectual Property

All content on We The Owl, including design, text, and code, is owned by Brix Tech Solutions unless otherwise noted. You may not reproduce or distribute any content without written permission. This does not apply to content you post to the community board, which is licensed to us as described in Section 6.

10. Disclaimer of Warranties

The Site is provided "as is" without warranties of any kind. We do not guarantee the accuracy of job listings, the accuracy of anything posted to the community board, the conduct of employers, job seekers, or other users, or that the Site will be uninterrupted or error-free. Community board content reflects the views of the person who posted it, not We The Owl.

11. Limitation of Liability

Brix Tech Solutions shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site, including but not limited to lost employment opportunities, hiring costs, or harm arising from content posted to the community board.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the new Terms.
